Terms of Service

These Terms of Service govern your use of the Tundral website and your engagement with Tundral's services. By using our website, requesting an audit, or engaging Tundral to provide services, you agree to these Terms.
Specific client engagements may also be governed by a separate proposal, statement of work, service agreement, or other written agreement. If there is a conflict between these Terms and a separately executed client agreement, the client agreement will control with respect to that engagement.
1. Services
Tundral provides AI search visibility, monitoring, analysis, and optimization services for businesses.
Depending on the agreed scope, our services may include:
AI search visibility audits and benchmarking
Competitive visibility analysis
Website, entity, and structured-data analysis
Content and information architecture recommendations
Business profile and citation analysis
Reputation and review analysis
Third-party authority and visibility research
AI search monitoring and reporting
Implementation of agreed optimization initiatives
Coordination with a client's existing website, SEO, advertising, or marketing providers
The specific scope, deliverables, fees, and billing terms for a client engagement will be communicated separately and agreed upon before paid work begins.
2. AI Search Results and No Guarantee of Results
AI-powered search systems, search engines, recommendation systems, and other third-party platforms are operated by independent companies and change frequently.
Tundral does not control how these systems rank, cite, display, summarize, or recommend businesses.
Accordingly, Tundral does not guarantee any particular ranking, recommendation, citation, visibility level, traffic increase, lead volume, revenue result, or other specific outcome.
AI-generated responses may vary between users, sessions, locations, prompts, platforms, and points in time. Visibility measurements and benchmarks provided by Tundral represent observations made using the methodology and testing conditions described at the time of analysis.
Our services are designed to identify and strengthen factors that may improve how a business is understood, discovered, and represented across AI-powered search, but results cannot be guaranteed.
3. Engagement and Payment
Fees and billing terms will be specified in the applicable proposal, order form, statement of work, or service agreement.
Unless otherwise agreed in writing, fees are due according to the payment schedule provided at the beginning of the engagement.
For recurring services, fees are generally billed in advance for each applicable service period.
Tundral may pause services if an invoice becomes materially overdue and may resume services once outstanding amounts have been paid.
Except where otherwise required by law or agreed in writing, fees for services already performed are non-refundable.
4. Scope and Changes
Tundral will provide services within the scope agreed upon with the client.
AI search optimization may involve work that overlaps with website development, traditional SEO, content, business profiles, reputation management, public relations, advertising, or other marketing activities.
Where a client uses another agency or service provider, Tundral may coordinate with that provider when appropriate. Unless specifically included in Tundral's agreed scope, Tundral is not responsible for work performed—or not performed—by another agency, contractor, platform, or service provider.
Material work requested outside the agreed scope may require additional fees or a revised agreement.
5. Client Responsibilities
To provide services effectively, Tundral may require reasonable cooperation from the client.
Clients agree to:
Provide accurate information about their business, services, locations, and operations
Provide timely access to websites, business profiles, analytics, or other systems when required for the agreed scope
Identify any existing agencies or providers whose work may overlap with Tundral's services
Review and approve material business information or changes when reasonably requested
Notify Tundral of significant changes to their website, business information, service areas, marketing providers, or other relevant systems
Tundral is not responsible for delays or reduced effectiveness caused by inaccurate information, unavailable access, delayed approvals, third-party actions, or circumstances outside our reasonable control.
6. Access to Client Systems
Clients may grant Tundral temporary access to websites, business profiles, analytics platforms, marketing tools, or other systems necessary to provide the agreed services.
Tundral will access only those systems and information reasonably necessary to perform its services.
The client represents that it has authority to provide Tundral with such access.
Tundral may use third-party technology and service providers as reasonably necessary to perform its services, subject to appropriate handling of client information.
7. Intellectual Property
Clients retain ownership of their existing websites, trademarks, business information, accounts, content, and other materials provided to Tundral.
Upon payment of applicable fees, clients may use client-specific reports, recommendations, content, configurations, and other deliverables created specifically for them as part of the engagement.
Tundral retains ownership of its underlying methodologies, processes, software, systems, templates, frameworks, scoring methods, research methods, benchmarking approaches, know-how, and other tools used to provide its services.
Tundral may use generalized and aggregated knowledge developed through its work to improve its services, provided that doing so does not disclose confidential client information.
8. Confidentiality
Tundral will use reasonable care to protect confidential business information provided by clients and will not disclose such information except as reasonably necessary to provide the services, as authorized by the client, or as required by law.
Confidential information does not include information that is publicly available, independently developed without use of the client's confidential information, or lawfully obtained from another source without confidentiality restrictions.
Nothing in these Terms prevents Tundral from analyzing publicly available information about a client or its competitors as part of its services.
9. Third-Party Platforms and Services
Tundral's services may depend on or interact with third-party platforms, including AI providers, search engines, website platforms, analytics providers, business directories, review platforms, marketing tools, and other technology services.
Tundral does not control these third parties and is not responsible for changes to their algorithms, policies, availability, functionality, data, rankings, recommendations, or other behavior.
A third-party platform may modify or remove information, restrict access, change its recommendation systems, or discontinue features at any time.
Tundral is not responsible for losses resulting solely from such third-party actions outside Tundral's reasonable control.
10. AI-Generated and Automated Analysis
Tundral may use artificial intelligence, software, automation, and other technology to assist with research, analysis, monitoring, reporting, content development, and service delivery.
AI-generated information can occasionally be incomplete, inconsistent, or inaccurate. Tundral uses reasonable review processes for material client deliverables but does not represent that automated or AI-generated information will always be error-free.
Clients should not rely on Tundral's AI-generated analysis as legal, financial, tax, engineering, safety, or other regulated professional advice.
11. Term and Termination
The duration and cancellation terms of paid engagements will be specified in the applicable client agreement or proposal.
Unless a minimum commitment or different cancellation period is agreed upon in writing, recurring services may be terminated by either party upon 30 days' written notice.
Upon termination, the client remains responsible for fees accrued or services performed through the effective termination date.
Tundral may terminate or suspend an engagement for material nonpayment, misuse of our services, unlawful activity, or a material breach of an applicable agreement.
12. Protected Markets
Where Tundral expressly grants a client geographic exclusivity or a protected market, the applicable geography, duration, conditions, and limitations will be defined in the client's written agreement.
No geographic exclusivity is created merely by requesting an audit, communicating with Tundral, or using the Tundral website.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Tundral will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost business opportunities, lost data, or business interruption arising out of or relating to the website or services.
To the maximum extent permitted by applicable law, Tundral's aggregate liability arising from a paid client engagement will not exceed the fees paid by the client to Tundral for the services giving rise to the claim during the six months preceding the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be excluded or limited.
14. Website Use
You may use the Tundral website for lawful purposes only.
You may not attempt to interfere with the operation or security of the website, gain unauthorized access to Tundral's systems, misuse information obtained through the website, or use the website in violation of applicable law.
Content on the Tundral website is provided for general informational purposes and should not be interpreted as a guarantee of specific business or marketing results.
15. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.
Before initiating formal proceedings, the parties agree to make a reasonable good-faith effort to resolve disputes informally.
16. Changes to These Terms
Tundral may update these Terms from time to time.
Updated Terms will apply to use of the website after the effective date shown above. Existing paid client engagements will remain subject to the terms of any separately executed agreement governing that engagement.
